Abacus Stop Repossession of Client’s Home.

We successfully stopped an eviction this morning (14th November) in the Oldham County Court.

A member of Abacus staff attended the Court with a solicitor in an Application to Suspend a Warrant for Possession from SPML Home Loans, on behalf of our client. The client had been ordered to pay arrears of around £3000 before 11.30 tomorrow, or the Bailiffs would enforce the warrant and repossess the property.

We assisted our clients in completing all the relevant and necessary documentation to put before the court to stop the eviction. It was also explained to the Court that we are preparing an IVA for the client. This will allow the clients to pay the mortgage arrears over a 36 month period and the unsecured debts over a 60 month period.

The court suspended the warrant, and our clients were able to keep their home.

  1. The background to this case was very simple, the clients had been seriously overcommitted by their own bank, taking on large debts with them. When times got hard due to illness so no fault of their own, the bank would take its own unsecured payments instead of paying the mortgage (please see elsewhere on the advice section as to how dangerous it is to have debt with your own bank). The staggering thing was the mortgage was WITH THE SAME BANK!!!
