Eviction Stopped within 24hours

A client facing repossession phoned our office at 10am on a Monday morning. They were due to be evicted from their home the next morning. They had over £20,000 or mortgage arrears and already had had a repossession order suspended twice. The client's latest difficulties were do to a period of unemployment, however they were due to start a new job the next week and were confidant of being able to make good the arrears over time.

A suspension was obtained at a 9 45 am emergency hearing the following morning. Our client was able to keep there home just in the nick of time. This example shows it's never too late to seek the proper advice to prevent repossession.

Eviction Stopped With One Day To Spare

Eviction successfully stopped in the Oldham County Court.
A member of Abacus staff attended the Court with a solicitor in an Application to Suspend a Warrant for Possession from SPML Home Loans, on behalf of our client. The client had been ordered to pay arrears of around £3000 before 11.30 the next day or Bailiffs would enforce the warrant and repossess the property.

We assisted our client in completing all the relevant and necessary documentation to put before the court to stop the eviction. It was also explained to the Court that we are preparing an IVA for the client. This will allow the client to pay the mortgage arrears over a 36 month period and the unsecured debts over a 60 month period.

The background to this case was very simple, the client had been seriously overcommitted by their own bank, taking on large debts with them. When times got hard due to illness, the bank would take its own unsecured payments instead of allow our client to pay their mortgage. This is an example of why you should avoid debts with your bank.

Arrears of £5000 - but only suspended repossession order given

SPML Home Loans applied for a 28 day possession order of our client's home.

We advised the client of their rights and how the law is there to protect them. We completed a financial statement and attended the Runcorn County Court to offer £150 per month towards the arrears of £5000. The Court accepted our offer and the possession order was suspended subject to maintaining agreed payments.

Latest Repossessions Stopped

28th April 2008, Salford County Court
Abacus got an exisitng repossession order suspended at 10am with repossession due to take place 90 minutes later. Client had arrears of £2,942 and ordered to pay £100 per month towards the arrears, clearing them in 30 months.

23rd April 2008, Darlington County Court
Mortgage in arrears by £29,000 arrears with the Halifax. Repossession order suspended and client ordered to pay £7,000 upfront plus an extra £600 per month towards arrears.

17th April 2008, Harrogate County Court
£8,000 in arrears with repossession due to take place 48 hours before calling Abacus. Repossession order suspended so long as client maintains £150 per month towards arrears.
